1.About these terms
These terms are an agreement between you and Ilyas Abdulkadir, a sole trader established in Portugal, trading as crawlfeed (“we”, “us”). They cover the crawlfeed website, dashboard and API (the “Service”). By creating an account or using the Service you accept them.
Our Privacy Policy explains how we handle personal data. Contact us at support@crawlfeed.dev.
2.Business and consumer customers
The Service is built for developers and businesses. If you use it for your trade, business or profession, you are a business customer. If you are an individual using it outside your trade or profession, you are a consumer, and you keep every right that consumer law in the UK or your EU country gives you. Nothing in these terms removes those rights. Where a section treats the two differently, it says so.
3.Your account and API keys
- You must be at least 18 and give accurate information when you sign up.
- You are responsible for everything done with your account and API keys. Keep keys secret, keep them out of browser and mobile code, and revoke any key you think has leaked.
- Each person may hold one account for the free credits. Creating extra accounts to collect more free credits is not allowed.
- Tell us promptly at support@crawlfeed.dev if you believe your account has been compromised.
4.Credits, prices and payment
- The Service is paid for with credits. Each call costs the number of credits shown in our documentation at the time of the call.
fresh=truecosts 2× the listed price and enrichment adds the listed surcharge. - Every verified account receives 100 free credits once. Further credits are bought in one-time packs. There is no subscription.
- Purchases are processed by Polar, which acts as the merchant of record and reseller: Polar handles payment, invoicing and any VAT or sales tax, and its checkout terms apply to the payment.
- Credits do not expire. They have no cash value, cannot be transferred to another account, and are not refundable except as set out in section 5 or where the law requires.
- A call that fails because of us, the platform or the data provider is not charged; the credits are returned to your balance automatically.
- We may change the credit price of calls or packs. Changes apply only to future calls and purchases, and we will give at least 30 days’ notice of any increase to the credit price of existing calls.
5.Cancellation and refunds
Consumers. You may cancel a credit pack purchase within 14 days of buying it. We will refund the price of the credits you have not used; credits already used are not refunded. To cancel, email support@crawlfeed.dev from your account’s address. We refund through Polar within 14 days of your request, to the original payment method.
Business customers. Purchases are final, except that we refund unused paid credits if we close your account without you having breached these terms, or if we stop providing the Service.
6.Acceptable use
You must use the Service lawfully. In particular, you must not use it to:
- stalk, harass, threaten, dox or intimidate anyone;
- monitor or profile identifiable individuals to make decisions about their employment, housing, credit, insurance, education or access to services;
- infer or collect special category data about individuals, such as health, sexual orientation, religion, political opinions or ethnic origin;
- send spam or unsolicited marketing using contact details obtained through the Service;
- obtain data that is not public, or try to access private accounts or content behind a login;
- infringe anyone’s intellectual property or other rights;
- share, publish or sell your API keys, or resell direct access to the API as a competing service without our written permission;
- get around rate limits, credit metering or security measures, or test the security of the Service without our written permission;
- disrupt the Service or place an unreasonable load on it.
7.Personal data you obtain through the Service
Results can contain personal data about the people who published them. For the data you receive, you are an independent controller under UK and EU GDPR and responsible for your own compliance, including:
- having a lawful basis for your use;
- telling people how you use their data where the law requires it;
- keeping it no longer than you need, and keeping it secure;
- responding to requests from the people it relates to.
If someone asks us to delete their data and you hold a copy you obtained from us, we may ask you to delete it too, and you agree to do so where the law requires it.
8.Third-party platforms and data
The data the Service returns belongs to the platforms and people who published it, not to us. Platforms change, limit or withdraw access without notice, so we cannot guarantee that a platform, endpoint or field will remain available or complete. We may stop serving a platform, or part of one, at any time, including where a platform’s terms or the law require it. You are responsible for complying with any terms that apply to your use of third-party content.
9.Intellectual property
We own the Service, its software, documentation and branding. Subject to these terms and to the rights of third parties in the underlying content, you may use the results you receive in your own products and services. If you send us feedback, we may use it without any obligation to you.
10.Changes and availability
We work to keep the Service available and accurate but do not promise that it will be uninterrupted or error-free, and we offer no service-level agreement. We may change the Service. Where a change would break existing integrations, such as removing an endpoint or a response field, we will give reasonable notice where we can.
11.Suspension and closing your account
You can close your account at any time under Settings in the dashboard, or by emailing support@crawlfeed.dev.
We may suspend or close your account if you breach these terms, if your use creates a legal or security risk, or if the law requires it. Where reasonable, we will warn you first and give you a chance to fix the problem. If we close your account because you breached these terms, unused credits are forfeited, except where consumer law gives you a right to a refund.
12.Our responsibility to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Consumers. We provide the Service with reasonable care and skill. If we fail to, you have legal rights and remedies, which these terms do not affect. We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our negligence. We are not responsible for business losses.
Business customers. Except as stated above, the Service is provided “as is”, and we are not liable for loss of profits, revenue, business, goodwill or data, or for any indirect or consequential loss. Our total liability to you in any 12-month period is limited to the amount you paid us in that period.
13.Claims about your use (business customers)
If you are a business customer, you will compensate us for reasonable losses and costs arising from a third-party claim that your use of the Service broke these terms or the law.
14.Changes to these terms
We may update these terms. We will give you at least 30 days’ notice by email or in the dashboard before a material change applies. If you do not agree, you can close your account before the change takes effect; consumers are then refunded for unused paid credits.
15.Governing law and disputes
These terms are governed by the laws of Portugal, and the Portuguese courts have jurisdiction over any dispute.
If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, including in the United Kingdom, and you may bring proceedings in its courts. Please contact us first at support@crawlfeed.dev; most problems are solved quickly that way.
Consumers in Portugal may also use alternative dispute resolution. The competent entity for online consumer disputes is the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC, cniacc.pt), and complaints can be filed in the electronic complaints book (Livro de Reclamações).
16.General
- If any part of these terms is found unenforceable, the rest remains in effect.
- If we do not enforce a right straight away, we can still enforce it later.
- You may not transfer your rights under these terms without our consent. We may transfer ours to someone who takes over the Service, and will tell you if we do.
- These terms and the documents they refer to are the whole agreement between us about the Service.
